Welcome to sparkED Fundraising (“sparkED,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of the sparkED platform located at https://sparkedfund.org (the “Site”) and all related services (collectively, the “Services”).
By accessing or using our Services, you agree to these Terms. If you do not agree, please do not use our platform.
1. About sparkED
sparkED is a marketing company that provides a digital fundraising platform to schools, teams, and organizations. We support campaign setup, provide promotional resources, and collect funds on behalf of participating schools or teams in exchange for a service fee. All funds are remitted to the organization minus applicable fees after the close of the campaign.
2. Eligibility
To use our Services, you must be at least 18 years old and authorized to act on behalf of a school, team, or organization. By creating a campaign, you confirm you have this authority.
3. Fund Collection and Disbursement
sparkED collects payments from supporters and processes all funds through secure third-party payment processors. Upon campaign completion:
Collected funds will be totaled and service fees deducted.
A detailed remittance report will be issued.
Net proceeds will be distributed to the school or organization via ACH or check.
sparkED is not responsible for delays or errors caused by third-party payment processors or incorrect payment details submitted by the campaign organizer.
4. Use of Services
You agree to use the Services only for lawful, legitimate fundraising purposes. You may not:
Misrepresent your affiliation with a school or team.
Post misleading content or fraudulent campaigns.
Interfere with the functionality of the platform.
sparkED reserves the right to suspend or terminate accounts that violate these Terms.
5. Campaign Setup and Account Access
To launch a campaign, organizers must submit required setup details and approve all product options and branding prior to campaign launch. You are responsible for safeguarding your account credentials and maintaining accurate information throughout the campaign period.
6. Fees and Pricing
sparkED charges a flat-rate or percentage-based service fee, disclosed prior to the launch of each campaign. This fee covers marketing support, web platform access, customer service, and financial processing. Additional production, shipping, or customization fees may apply and will be outlined in the campaign proposal.
7. Intellectual Property
All platform content, designs, logos, and system architecture are the property of sparkED. Schools or teams retain ownership of their own logos and provided media. You may not reproduce or repurpose sparkED platform assets without express written consent.
8. Refunds and Returns
All orders placed by supporters are final unless otherwise specified. Refunds for merchandise, if allowed, are handled at sparkED’s discretion or in accordance with the return policy of the specific campaign.
9. Limitation of Liability
sparkED shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Services. Our maximum liability shall not exceed the amount of service fees paid to us for the relevant campaign.
10. Indemnification
You agree to indemnify and hold harmless sparkED, its officers, agents, and employees from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.
11. Termination
We may terminate or suspend your access to the Services at any time for violation of these Terms or for conduct harmful to the platform or our clients. Any remaining funds due to an organization will be disbursed in accordance with our campaign closeout policy.
12. Modifications
We reserve the right to update these Terms at any time. Material changes will be posted to this page, and continued use of the Services constitutes acceptance of the new terms.
13. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules.
